Datenschutzrichtlinie – Mindworx Coaching (Südafrika)

1) Who we are

2) Scope

 

This policy applies to all personal information we process through our website, coaching services, app, WhatsApp hotline, email, and related channels, in terms of the Protection of Personal Information Act, 2013 (POPIA). It also notes additional rights for visitors from the EU/UK.

3) What we collect

  • Identity & contact data: name, email, phone, role, organisation, location.

  • Coaching data: assessments, goals, session notes, progress metrics, feedback.

  • Transaction data: invoices, payments (processed via third-party payment providers; we do not store card numbers).

  • Usage & device data: pages viewed, timestamps, IP, device/browser info, app interaction data; collected via cookies/SDKs.

  • Communications: WhatsApp and email messages (metadata and content to support you in real time).

4) How we collect

​

  • Directly from you (forms, bookings, sessions, WhatsApp/email).

  • Automatically via our site/app (cookies and similar tech). See Cookie Notice below. POPIA applies to cookies in South Africa even though not named explicitly.

5) Why we process (lawful bases under POPIA)

​

We process personal information to:

  • deliver coaching, support, and app access;

  • run assessments, set goals, and track progress;

  • manage accounts, billing, and client service;

  • secure our systems and prevent abuse;

  • improve our services and site/app;

  • send service notices and, with your permission, direct marketing you can opt out of anytime.
    Direct electronic marketing requires prior consent (or an existing customer relationship subject to strict rules).

6) Direct marketing choices

​

We only send electronic marketing (email/SMS/WhatsApp) if you’ve consented in the prescribed manner or you’re an existing customer within POPIA limits. You can opt out at any time from any message.

7) Retention

​

We keep data only as long as necessary for the purposes above, contractual/legal requirements, or to resolve disputes and enforce agreements, then delete or de-identify it.

 

8) Sharing with Operators (service providers)

​

We use vetted Operators under POPIA-compliant contracts, including:

  • Website & hosting: e.g., Wix or equivalent;

  • Analytics: e.g., Google Analytics (IP/device, usage);

  • Messaging: WhatsApp/Meta for hotline, email service providers;

  • Payments & invoicing: payment gateways, accounting tools;

  • Security & infrastructure: cloud providers.
    We require operators to safeguard your information and process only on our documented instructions.

9) Cross-border transfers

​

Because we use global cloud services, your information may be processed outside South Africa. We rely on POPIA section 72 mechanisms (adequate protections, contractual safeguards, or your consent/necessity for contract performance).

10) Security

 

We use administrative, technical, and physical safeguards (access controls, encryption in transit, least-privilege, logging, staff confidentiality) appropriate to the sensitivity of the data. If we believe a security compromise occurred and it poses a risk of harm, we will notify you and the Information Regulator as soon as reasonably possible, considering law-enforcement needs and remediation steps.

11) Your rights (POPIA data subject rights)

​

You may request to access, correct, delete, or object to certain processing; withdraw consent; or lodge a complaint. We’ll respond within reasonable timeframes and may require verification of identity. To exercise rights, contact [Information Officer email].

12) Children

​

Our services are intended for adults. We do not knowingly collect personal information of children without the consent of a competent person per POPIA. If you believe a child has provided data, contact us to remove it.

13) Cookies & similar technologies

​

We use necessary cookies to run the site/app and optional analytics cookies to improve performance. Where required, we ask for cookie consent and provide a preferences link. You can also control cookies via your browser settings; blocking some cookies may impact functionality.

 

14) WhatsApp & email hotline

​

When you message us via WhatsApp or email, your personal information (including message content and metadata) is processed by those providers subject to their terms. Do not send highly sensitive data over unsecured channels.

15) PAIA

​

If applicable, our PAIA Manual (access to information) is available on request and explains how to request access to records we hold under the Promotion of Access to Information Act.

16) Changes to this policy

​

We may update this policy from time to time. Material changes will be communicated via our website/app or email. Continued use after an update means you accept the revised policy.
